Changes to the Terms of Use

One Magical City reserves the right, at any time in our sole discretion, to modify or replace content on the Site and any part of these Terms of Use, and to modify, suspend or discontinue, temporarily or permanently, the Services, without prior notice. One Magical City shall not be liable to you or to any third party for any such modification, suspension or discontinuance of the Services.

You agree that we may notify you of any updated Terms of Use by posting them on the Site so that they are accessible via a link from the home page. All such changes are effective immediately when we post them, or such later date as may be specified in the updated Terms of Use, and will apply to your use of the Services from that point forward. Your continued use of the Services following the posting of revised Terms of Use (or engaging in such other conduct as we may reasonably specify) means that you accept and agree to the changes. Access and Account Information

In order to access certain portions of the Services, you may need to register and provide certain personal information. One Magical City’ policies with respect to the collection and use of personal information are set forth in One Magical City’ Privacy Policy. This policy explains how One Magical City treats your personal information when you access and use the Services. The policy may be updated from time to time at our discretion.

You must not create accounts with the Services through unauthorized means, including but not limited to, by using a script, bot, spider, crawler, or scraper, or other automated methods. These accounts will be removed upon detection. You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process (“Account Information”). Your login may be used by only one person – a single login shared by multiple individuals is not permitted. When you choose to provide information to the Services, you agree that all information you provide to register with the Services and to create your account shall be true, accurate, current and complete, and you agree to update your information as necessary to ensure that it remains true, accurate, current and complete. You understand and agree that you are responsible for maintaining the confidentiality and security of your password and other Account Information, and that you are solely responsible for all activities that occur on or through your account. You agree to notify One Magical City immediately if you suspect any unauthorized use of your account or access to your password. You agree that you will not solicit, collect or use the login credentials of other users. We reserve the right, at any time, in our sole discretion, to disable any user name, password or other identifier, whether chosen by you or provided by us, and to terminate your account or otherwise deny you access, without notice and without liability.

Although it is One Magical City’ intention for the Services to be available as much as possible, there will be occasions when the Services may be interrupted, including, without limitation, for scheduled maintenance or upgrades, for emergency repairs, or due to failure of telecommunications links and/or equipment. One Magical City will not be liable to you for any such interruption of the Services, or the loss of any Content. You also acknowledge that the Internet may be subject to breaches of security and that the submission of Content or other information may not be secure. One Magical City reserves the right at any time and from time to time to modify, suspend or discontinue, temporarily or permanently, the Services (or any part thereof) with or without notice. v shall not be liable to you or to any third party for any such modification, suspension or discontinuance of the Services.

Cancellation, Suspension and Termination

You may cancel your account at any time. You are solely responsible for properly cancelling your account.

One Magical City, as it deems necessary and in its sole discretion, may suspend or terminate your account at any time. Without limiting the foregoing, we may restrict, suspend or terminate your access to all or part of the Services if we believe you are in breach of these Terms of Use or applicable law, or for any other reason, without notice or liability. One Magical City reserves the right to refuse provision of or access to the Services to anyone for any reason and at any time. Any termination or suspension of the Services may result in the deactivation or deletion of your account or access to your account, and may also result in the forfeiture and relinquishment of all content in your account, as determined by One Magical City in its sole discretion.

Verbal, physical, written or other abuse (including threats of abuse or retribution) of any One Magical City customer, employee, member, or officer will result in immediate account termination. We reserve the right to not intervene in interpersonal disputes.

Upon termination, all license and other rights granted to you in these Terms of Use will immediately cease (provided, however, that you will retain ownership of your User- Generated Content). If we terminate your access to the Services or you cancel your account as described above, your User-Generated Content may persist and appear within the Services. This information, including your User-Generated Content, comments, relationships and all other data will no longer be accessible to you and cannot be recovered once your account is cancelled, and One Magical City shall not be liable for any claims or losses resulting from such deletions.

Social Distribution

One Magical City may allow you to share certain content with others (“Social Distribution”). For example, the Services may allow you to send certain User-Generated Content to friends, display User-Generated Content on your personal web site or post User-Generated Content on a third party web site. You agree that you will not imply that you and One Magical City are affiliated in any way or that One Magical City approves of your comments. We reserve the right to revoke our permission for Social Distribution at any time and for any reason, and you agree to immediately cease Social Distribution upon notice of revocation and to comply with any terms we post in connection with the Social Distribution of User- Generated Content.

Contests and Promotions

Any contests or promotions (“Promotions”) accessible through the Services may be governed by its own set of official rules, which may have eligibility requirements, such as certain age or geographic area restrictions. By entering or participating in such Promotions, you will become subject to those official rules. It is your responsibility to read the applicable rules to determine whether or not your participation, registration or entry will be valid or restricted, and to determine the sponsor’s requirements of you in connection with the applicable Promotion. Unless otherwise stated any taxes, fee or duties imposed by your jurisdiction due as a result of winning a contest or promotion for a product or service are payable by you.

Mobile Features

The Services may offer features that are available to you via your mobile phone or other mobile device. These features may include, without limitation, the ability to view One Magical City Content, upload Content to the Services, receive messages from the Services, download applications to your mobile device or access Services features (collectively, the “Mobile Features”). Message and data rates and other carrier fees may apply.

Email Notifications

If One Magical City wishes to provide notifications or receipts to you, One Magical City may do so by email at the address you provided to One Magical City when you created your account or as later updated. You hereby agree and acknowledge that One Magical City is not responsible to notify you in any way other than by email.

The Services may contain links to or interactions with third-party websites or resources (“Third Party Websites”). These links and interactions are provided for your convenience only. One Magical City neither endorses nor controls such Third Party Websites, and you acknowledge and agree that we are not responsible or liable for the information, content, products, or services on or available from such Third Party Websites, or for the results to be obtained from using them. If you choose to access any such Third Party Websites, you do so entirely at your own risk.
